Your Spanish nationality application was refused: reposición or the court, and the deadlines the texts give

If your application is refused, the texts give you two routes: a reposición appeal before the same body, within one month if the refusal is express, or a contencioso-administrativo appeal before the Audiencia Nacional, within two months. Both months are counted from the day after the notification. Below, every deadline is quoted from the BOE with its article, with the clocks that start with the notice and what to know before you pay a lawyer. This page does not tell you which route to take and does not work out a court date for you. Free.

1. What a refusal can rest on

The Civil Code says nationality by residence is granted by the Minister of Justice, who may refuse it for reasoned grounds of public order or national interest.

It also says the applicant must show good civic conduct and a sufficient degree of integration into Spanish society.

The Reglamento adds that a resolution based on the report of the Centro Nacional de Inteligencia is taken as sufficiently reasoned.

Real Decreto 1004/2015, art.

2. The notice and its date

A notification has to contain the full text of the resolution, whether it ends the administrative route, and the appeals that apply in the administrative and court routes.

Ley 39/2015, art.
It also has to say which body the appeals go to and the deadline.
Ley 39/2015, art.
The Reglamento says a nationality notice states the appeals that apply, the deadline and the body.
Real Decreto 1004/2015, art.

How you were notified matters for the date. A notice sent electronically counts as made when its content is accessed.

Ley 39/2015, art.
Where electronic notification is compulsory or you chose it, it is treated as rejected after ten natural days without opening it.
Ley 39/2015, art.
Write down the day it was made available and the day you opened it.

If the notice leaves something out. The law says a notice that has the full text but omits one of those items takes effect from the date you do something that shows you know its content and scope, or lodge any appeal that applies.

Ley 39/2015, art.
The quoted text does not say whether that changes a deadline in your case: ask a lawyer.

3. The two routes

After a refusal the texts describe two routes. The order on nationality says you may lodge an optional appeal for reposición before the same body that issued the act, or go straight to the Audiencia Nacional with a contencioso-administrativo appeal.

Orden JUS/1625/2016, art.
Ley 39/2015 says the same for acts that end the administrative route, without naming the court.
Ley 39/2015, art.

The routes are linked. You cannot go to court while a reposición you lodged is unresolved and not yet presumed refused.

Ley 39/2015, art.
Once it is resolved, the court deadline is counted from the day after the day on which the express answer is notified, or on which the appeal must be understood as presumed refused.
Ley 29/1998, art.

No answer at all after a year: what the official texts say

4. Counting the deadlines

The reposición month. Months are counted from the day after the notification.

Ley 39/2015, art.
The period ends on the same day of the month as the notification, in the month it expires.
Ley 39/2015, art.
If that month has no equivalent day, it ends on the last day of the month.
Ley 39/2015, art.
If the last day is not a working day, it moves to the next working day.
Ley 39/2015, art.

The court's two months. They are counted from the day after the notification.

Orden JUS/1625/2016, art.
The deadlines in the law on the courts (Ley 29/1998) cannot be extended: once one has passed, the court clerk records the right as expired.
Ley 29/1998, art.
This page does not say whether the month rules above also apply to the court deadline.

August is written into the court rules. During August the deadline to lodge the contencioso-administrativo appeal does not run, and neither does any other deadline in that law.

Ley 29/1998, art.
The fundamental-rights procedure is the exception: there August counts as a working month.
Ley 29/1998, art.
The article that counts months for the administrative appeal (Ley 39/2015, art. 30) has no August line in the text we read. This page does not tell you how August affects either of your deadlines: ask a lawyer.

5. A reposición letter against an express refusal

6. Lawyer, free aid and costs

For the court route, the law says that before a single-judge court the parties may give their representation to a procurador and are assisted, in every case, by a lawyer.

Ley 29/1998, art.
Before a collegiate court they must give their representation to a procurador and be assisted by a lawyer.
Ley 29/1998, art.
We found no text in these sources that says which of the two applies to your case at the Audiencia Nacional: ask. For reposición we found no line that requires a lawyer.

The free legal aid law names, among those entitled when they show insufficient means to litigate, foreigners who are in Spain.

We cannot tell you whether you meet the means test.

In the court route, costs can be imposed. At first or only instance they go to the party whose claims were all rejected, unless the court explains that the case raised serious doubts of fact or law.

Ley 29/1998, art.
In appeals they go to the appellant if the appeal is fully dismissed, unless the court explains that circumstances justify no costs order.
Ley 29/1998, art.
A lawyer must tell you about the consequences of a costs order and its approximate amount.

A second opinion before you pay a lawyer: the checklist

7. What the texts do not tell us

Ask a lawyer about

  • Which route fits your case: reposición first, or the court directly.
  • Which date your deadline runs from if you opened the notice late or it was treated as rejected after ten days.
  • Whether the notice you received contains everything the law lists.
  • How August affects your court deadline.
  • Whether a procurador is needed besides a lawyer for your case at the Audiencia Nacional.
  • What your chances are, and what a failed appeal would cost you.

These are general pointers, not an assessment of your case. A lawyer should confirm what applies to you. CiviqPass does not name or recommend a lawyer.

The nationality file, step by step

8. What happens if my nationality application is rejected?

If your application is refused (some people say rejected), the texts give you two routes: a reposición appeal before the same body, within one month if the refusal is express, or a contencioso-administrativo appeal before the Audiencia Nacional, within two months. Both months are counted from the day after the notification, so keep the notice and write down the day you received it. This page quotes each deadline from the BOE and does not tell you which route to take.
