1. What the request is

When the application or the documents you filed do not meet the requirements for nationality by residence, the regulation says the applicant or the representative is sent a request to fix the fault or to attach the documents that apply, electronically or as physical documents, so that they can be checked.

If you bring the fix on paper, the regulation says the steps are taken to include it in the electronic file.

The Ministry's order lists, among the steps of the instruction, asking you for any other document needed to prove the requirements of article 22 of the Civil Code, or when the ones you filed do not prove them well enough.

2. The three months

The regulation says the notification will state that, if you do not fix the fault within three months from when the request was notified to you, you are treated as having withdrawn your application, which is decided by a resolution.

The Ministry's order gives the same period: a fix period of three months from the notification of the request, to fix the fault or attach the documents requested.

The order adds that, while you answer, the period the Ministry has to resolve and notify the procedure is suspended, until you comply or the period you were given runs out.

3. How the three months are counted

The general counting rule is article 30 of Ley 39/2015. A period set in months is counted from the day after the notification.

None of these texts names the day you open it late as a new start for the three months. If you opened yours after the ten days, see a lawyer before you count.

How we count

Months and years end on the same day number, or on the last day of the month if there is no such day; they start the day after the date you give. A deadline that ends on a weekend moves to the next working day. Document validity is not moved: the date shown is the last day it stays valid, even on a weekend. Days are working days unless a law says otherwise.

4. Answering the request

The sede page for the nationality procedure says you can add documentation to a file already started in the sede.

It does not say that this is the route for answering a request. Your notification is where to look for how to answer; if it does not say, ask the Ministry.

5. If the three months pass

The order says the request will state that, if the fix is not made within the period, you are treated as having withdrawn and the procedure is archived for tacit withdrawal.

  • You opened the notification more than ten days after it was made available.
  • You have received a resolution that records your withdrawal.
