Where is my Spanish nationality file? The official ways to check it

The Ministry's online check of a residence nationality file asks for your NIE, your application number, the year and your date of birth, and shows which phase the file is in. This guide gives the steps, the Cl@ve route, how DEHú notifications reach you and the 10-day rule. Free; each line links its official source.

1. The official ways to check

For a nationality-by-residence file, the Ministry of Justice's sede offers the “Consulta telemática de expedientes de nacionalidad española por residencia” (online consultation of residence nationality files). Its page says you can check there which phase of the process your file is in.

The sede presents it as “Tramitación On-line sin Certificado Digital” (online, no digital certificate). The Ministry's own usage guide gives five steps:

If your grant resolution has already been notified, the same consultation gives access to the electronic original of the document.

What that page shows is not a notification: notifications are opened in DEHú (section 3).

The other route is “¿Cómo va lo mío?”, with Cl@ve. The Ministry of Justice's sede has a service called “¿Cómo va lo mío?”. After you identify yourself, it shows the state of your requests being handled by the Ministry.

The login it asks for is Cl@ve.

If that service shows nothing for your procedure, the same page points to a list of all the current “cómo va lo mío” services.

The page we read does not say how to consult files of other years. The Ministry's leaflet on notifications points to “¿Cómo va lo mío?” for checking the state of a nationality file.

2. What the status words do not tell you

None of the official pages we read lists the status words a nationality file can show, or explains them: not the “¿Cómo va lo mío?” page, not the Ministry's page on consulting files and not its leaflet on notifications. So this guide does not turn a status word into a promise.

We do not state a typical waiting time, because no official source we found publishes one.

What the law does give you is the right to know, at any time, the state of the procedure, the body that handles and decides it and the procedural acts issued.

Ley 39/2015, art. 53.1.aOfficial wordingA conocer, en cualquier momento, el estado de la tramitación de los procedimientos en los que tengan la condición de interesados;

If a word on your screen is unclear, the sources we read do not say who explains it. The letter template in the guide for a silent file asks the Ministry for the state of your file.

3. Notifications and the 10 days

Notifications on the file can be opened through the DEHú tool, according to the Ministry's leaflet.

The recipient is the person named when the application was made: you, or your legal or voluntary representative.

The leaflet labels notifications “pendientes” (not yet opened, within 10 natural days) and “realizadas” (opened, or past the 10 days, and so treated as made). These label notifications, not the state of your file.

The law says an electronic notification counts as made when you open it,
Ley 39/2015, art.
and that, when electronic notification is compulsory or you chose it, it counts as rejected once ten natural days pass without access.
Ley 39/2015, art.
The sources we read do not say whether electronic notification is compulsory for you or whether you chose it.

Check DEHú regularly. A notification left unopened for ten natural days can count as rejected when electronic notification is compulsory or was your choice; whether that applies to you, and what follows, depends on your case, so ask a lawyer if you think you missed one. If you named a representative, ask them to check too.

4. When nothing moves

The maximum time to decide is one year from when the application entered the Dirección General; after that, without an express decision, the application is treated as refused (desestimada).

Real Decreto 1004/2015, art.
What you can do then depends on your case: read the guide for a silent file and ask a lawyer. The file clock on the nationality-file page works out dates from the rules it quotes; it cannot tell you whether the one-year period was suspended in your case.

When to see a lawyer

  • You receive a refusal.
  • You think you missed a notification.
  • The status you see contradicts your documents or dates.
  • You are near a deadline and unsure whether it applies.

These are general triggers, not an assessment of your case. A lawyer should confirm what applies to you. CiviqPass does not name or recommend a lawyer.
