3. A letter asking for the state of your file
This is a plain request based on the right above. It is written in Spanish because that is the language of the file. It is addressed to the Dirección General de Seguridad Jurídica y Fe Pública, whose Subdirección General de Nacionalidad y Estado Civil heads the Ministry's own warning on this procedure. 4. The appeals the texts describe
- Reposición or the court. Against the grant or the denial, the ministerial order allows an optional reposición appeal before the same body, or going directly to the Audiencia Nacional. If a month passes after a reposición appeal without an answer, it is treated as refused by silence and the court route opens.
Orden JUS/1625/2016, art. 13.1Official wording
- Court deadlines. The deadline for the court appeal is two months from the day after the notification. If there was no notification, it is six months from the day after the presumed refusal happens.
Orden JUS/1625/2016, art. 13.2Official wording
The Tribunal Constitucional wrote in ruling 52/2014 that, in light of the 1999 reform of Ley 30/1992, it can be understood that a court challenge to a refusal by silence is not subject to the time limit of art. 46.1 LJCA.Orden JUS/1625/2016, art. 13.2Official wording
These two lines do not say the same thing, and we do not say which one counts for your file: ask a lawyer.
46.1 LJCA.
- Reposición after silence. If there is no express answer, the applicant may lodge a reposición appeal at any time from the day after the presumed refusal happens. The court route stays open.
Ley 39/2015, art. 124.1Official wording
Do not decide alone whether you are in time. Whether the court deadline has run for you, and which appeal fits, are legal questions that depend on your case. Ask a lawyer before you assume you are in time or out of it.
5. When to see a lawyer
When to see a lawyer
- You receive a refusal.
- A year has passed and you do not know which appeal fits your case.
- The answer about your file contradicts your documents.
- You are near a deadline and unsure whether it applies.
These are general triggers, not an assessment of your case. A lawyer should confirm what applies to you. CiviqPass does not name or recommend a lawyer.
