How we count

Months and years end on the same day number, or on the last day of the month if there is no such day; they start the day after the date you give. A deadline that ends on a weekend moves to the next working day. Document validity is not moved: the date shown is the last day it stays valid, even on a weekend. Days are working days unless a law says otherwise.

In short

  • Criminal record: People born in Algeria, or who lived there, can request bulletin no. 3 of the criminal record at the embassy's consular office; we found no Algerian validity period, and Spain's order treats a certificate with none as valid six months from issue.
  • Birth and marriage: An Algerian registered at a consulate requests the 12-S extract on the Interior Ministry site and collects it there; the ten years' validity has no stated start or version, and the apostille filing wants civil-status documents at most three months old.
  • Apostille: From 9 July 2026 the Interior Ministry issues the apostille for civil-status documents, which must be at most three months old at filing (start date not stated); the prosecutors general's offices do so for criminal records.
  • Translation: Spain's Ministry of Justice names consulates or a sworn translator-interpreter for the translation; Algeria's Interior Ministry says a translation needs its own apostille if the destination country requires one, and we found nothing on translations made in Spain.
  • Order: Our arithmetic, not an official rule: request first the documents that need an apostille and a sworn translation, the criminal record only when you can still finish both while it is valid; the apostille request wants civil-status documents at most three months old, from a date the page does not state; the clock below gives the dates.

Each line sums up a section below. The sources are in that section.

1. Criminal record certificate

The Spanish-language page of the Algerian embassy in Madrid (site mfa.gov.dz) says that nationals born in Algeria, and foreigners who lived in Algeria, can ask for bulletin no. 3 of the criminal record (casier judiciaire) at the consular office.[1] It says the bulletin is written in Arabic and that applicants can ask for a French version.[2]

2. Birth certificate, and marriage certificate if you are married

The Algerian Interior Ministry says a national living abroad files the request for the 12-S special birth-certificate extract directly on its website and collects it at the diplomatic or consular representation where the person is registered.[1]

The Madrid embassy's page says people born in Algeria and registered at a consular office can ask for the 12S online at demande12s.interieur.gov.dz.[2] It says the 12S are produced and sent to the diplomatic and consular missions for delivery to the people concerned.[3] It adds that any Algerian living abroad can ask for a 12S at any commune of the country during a stay in Algeria.[4]

The same page says that, on presentation of the family record book and an Algerian ID document, the civil-status service can issue family and individual records.[5] It says the service can also issue extracts of civil-status acts (birth, marriage, death) drawn up by the communes in Algeria or by the consular and diplomatic offices.[6]

Two different limits appear on the Interior Ministry's pages. Its page on civil status says the validity of the birth certificate is ten years, except when the marginal mentions are modified; the page does not say from which date the ten years count, or which version of the birth certificate it covers.[7] For the apostille request, the Ministry asks for civil-status documents with a validity not exceeding three months at filing, and the page does not say from which date those three months count.[8] The clock below shows both dates.

Spain asks for the birth certificate of the country of origin, legalised and translated where needed.[9] We found no official Spanish text saying whether an extract or a full copy is needed: ask the registry.

If you are married, Spain also asks for the marriage certificate of the country where the marriage took place.[10] For Algerian marriage certificates, the only official Algerian page we could read is the Madrid embassy page above, which lists extracts of marriage acts among those its civil-status service issues: ask your consulate for the steps.

3. Apostille and legalisation

The HCCH (Hague Conference on Private International Law) says Algeria deposited its instrument of accession to the Apostille Convention on 5 November 2025.[1] It says the Convention entered into force for Algeria on 9 July 2026.[2]

The Algerian Interior Ministry says the apostille system is applied from 9 July 2026 at the level of that ministry.[3] A notice on the Algerian embassy in Beijing's site says that from that date public documents within the scope of the Convention and meant for use in party states are no longer subject to the traditional legalisation procedure.[4] It says that, in a first phase, the apostille is issued in Algeria only for documents of the sectors of the Interior, Local Authorities and Transport, Justice, and Higher Education and Scientific Research.[5] It adds that the system will be extended progressively to documents of other sectors.[6]

The HCCH notifications page for Algeria records an objection from Austria.[7] It records one from Greece.[8] It records one from Germany.[9] It lists none from Spain: see the country finder on the "nationality file" page of this site. The Interior Ministry says ordinary legalisation, done at the Ministry of Foreign Affairs and the consulates, remains valid in certain cases.[10] One of them is for member states that made official objections to Algeria's accession.[11]

For criminal record certificates, the HCCH page for Algeria says the prosecutor general's offices at the courts of appeal are competent to issue the apostille.[12] For civil-status documents, the Interior Ministry says the apostille is issued at all the administrative circumscriptions of Algiers province and, for the other provinces, at the daïra that is the provincial capital.[13] Its list includes the birth certificate (full copy or extract)[14] and the marriage certificate (full copy or extract).[15]

The Interior Ministry says the apostille service is open to citizens and to foreigners registered in the civil-status registers in Algeria.[16] For civil-status acts, it says only five categories of people may ask for them. The first three are the holder, the spouse, and ascendants and descendants.[17] The fourth is the legal guardian, with an official power of attorney.[18] The fifth is any person authorised by a court decision.[19]

Its steps start with access to the national digital platform for apostille requests.[20] The last step you take yourself is to present yourself to the competent authority with an ID card, the document and the apostille forms.[21] Step 8 says the apostille is then produced and affixed to the document.[22] It says the apostille certificate is obtained from the tax collection offices or Algérie Poste branches.[23] We found no readable official page saying how a person living in Spain can obtain the apostille without travelling, and none giving the price of the certificate: ask your consulate.

The Interior Ministry's Arabic page says an apostille request takes between 3 and 5 days to process.[24] Its French page says civil-status documents must be recent, with a validity not exceeding three months at the time of filing; the page does not say from which date those three months count.[25] It says the apostille has no fixed validity of its own, because its validity follows that of the official document it authenticates.[26] The Spanish Ministry of Foreign Affairs says legalisation has no expiry date, but that if the document has a validity period, legalisation does not extend it.[27]

The Spanish consulate in Oran says documents issued from 9 July 2026 must be presented with an apostille, since Algeria has joined the Hague apostille.[28] The Spanish consulate general in Algiers says it has stopped legalising documents issued by Algerian authorities.[29] It adds that, for Algerian documents to be valid in Spain, the Hague apostille must now be obtained from the competent Algerian authorities.[30]

The Spanish Ministry of Justice warning calls legalisation an essential requirement for foreign documents.[31] It describes the Hague procedure as a single stamp and signature on the document.[32]

4. Translation into Spanish

The Madrid embassy's page says the criminal record bulletin is written in Arabic and can be requested in French.[1] We found no readable Algerian page saying which language the birth certificate comes in.

The Interior Ministry says that if the destination country requires a translation of the document, the translation needs its own separate apostille.[2] We found no official page saying how this applies to a translation made in Spain: ask the registry or your consulate.

The Spanish Ministry of Justice warning says translation is done or checked at Spanish consulates abroad, or at the consulates in Spain of the document's country of origin, or by a sworn translator-interpreter named by the Ministry of Foreign Affairs, and that the documents must then be legalised.[3][4] The Ministry of Foreign Affairs describes a sworn translator as a professional who can translate written documents from one language into another.[5]

5. Consulates in Spain

The Algerian embassy in Madrid gives its address as C/ General Oraá, 12, 28006 Madrid, and its site has the consular pages quoted above.[1]

A site on mfa.gov.dz titled "Consulate General of Algeria in Barcelona"[2] prints the address Av. del Tibidabo, 6, 08022 Barcelona in its page footer.[3] The service pages of that site that we opened showed no text.

We found no readable official Algerian page listing the other Algerian consulates in Spain or the area each covers: ask the embassy.

6. Order of requests and validity

Spain's order says that all documents must be in force when you apply.[1] For certificates, the validity stated on the certificate itself counts,[2] and a criminal record certificate with no stated validity counts for six months from the day it was issued.[3]

Legalisation does not make a document last longer. Spain's Foreign Ministry says legalisation has no expiry date but that, if the document has a validity period, legalisation does not extend it.[4]

When you create the online application you have two months to complete and file it, or it is deleted.[5]

Our arithmetic, not an official rule. The sources above fix how long a document stays valid, not the order in which you request things. If the validity counts from the day of issue, and the apostille and a sworn translation take time afterwards, the request date matters most for the documents with the shortest validity. Type a date in the clock below to see when your criminal record certificate stops being valid, then count back the time the apostille and the translation take in your case.

  1. Find out what validity, if any, each issuer prints on its certificate (the sections above say what we found).
  2. Request first the documents that need an apostille and a sworn translation, since those steps come after issue.
  3. Request the criminal record certificate when you can still finish its apostille and translation inside its validity.
  4. Type its issue date in the clock below and file before the "valid until" date it shows.
  5. Create the online application only when you are close to filing: from creation you have two months.
