Months and years end on the same day number, or on the last day of the month if there is no such day; they start the day after the date you give. In short
- Criminal record: The Registro Central de Sancionados of the Ministry of Justice keeps the records; for use abroad the Ministry's FAQ names Consultoría Jurídica Internacional or, from abroad, a Cuban consulate (a 2022 news item names more companies), and we found no page on the validity of a certificate for use in Spain: a Cuban embassy page says a 2023 resolution set one year for Cuban purposes, while Spain applies the certificate's own term or else six months, and the clock uses six months.
- Birth and marriage: The Ministry of Justice says to ask at the civil registry office of your area or where the birth is registered; the Sevilla consulate's page lists birth certificates among the documents it can request from Cuba, which can take up to a month to be received; we found no page on what to submit to request one from abroad, and no official validity.
- Legalisation: Spain's consulate in Havana says Cuba has not signed the Apostille Convention and we did not find Cuba in the HCCH table, so the route described is legalisation by the Cuban authority and then the Spanish consulate in Havana, or in Spain the Foreign Ministry's Legalisation Service; legalisation moved to the Ministry of Justice in February 2025, and we found no price or delay for a birth certificate.
- Translation: We found no official page saying whether a document already in Spanish needs translation; Spain's order says "traducido en su caso" for the birth certificate and "traducido" for the criminal record.
- Order: Our arithmetic, not an official rule: request first the documents that need legalisation and a sworn translation, then the criminal record certificate, so that you can finish its legalisation and translation while it is still valid; the clock below gives the dates.
- Consulates: Cuba's Foreign Ministry lists five consulates general in Spain: Madrid, Barcelona, Islas Canarias, Santiago de Compostela and Sevilla.
Each line sums up a section below. The sources are in that section.

1. Criminal record certificate
The Cuban Ministry of Justice's FAQ says the Registro Central de Sancionados registers, certifies and cancels the criminal records of people sentenced by Cuba's courts or by foreign courts.[1]

2. Birth certificate, and marriage certificate if you are married
The Ministry of Justice's FAQ answers the question of where to request a birth certificate: at the civil registry office of your area or the one where your birth is registered.[1] The same FAQ lists, among the special services of the Consultoría Jurídica Internacional, the educational and registry documents that are contracted from Cuban consulates abroad.[2] That line does not name birth certificates, and we found no Ministry page that says what a person must submit to request one from abroad.
The Sevilla consulate's page lists birth and marriage certificates among the documents that can be requested from Cuba through the consulate.[3] It says such a request can take up to a month to be received.[4]
The Ministry's FAQ says Estado Civil certificates obtained in one province cannot be presented for legalisation at a Consultoría Jurídica Internacional office in another province: only at the offices in the province where they were issued.[5] The Ministry's notice on the new legalisation rules lists birth, marriage and death certificates in its scope.[6]
Spain asks for the birth certificate of the country of origin, duly legalised and translated "en su caso" (where applicable).[7] If you are married, it also asks for the marriage certificate of the country where the marriage took place.[8] We found no official Spanish text saying which kind of copy (extract or full) it wants: ask the registry.
Validity. Spain's order says all documents must be in force when you apply.[9] We found no official page that states a validity for a Cuban birth certificate.

3. Legalisation
The Spanish Consulate General in Havana's page says the Republic of Cuba has not signed the 1961 Convention on the apostille.[1] The HCCH status table for that Convention (last update 30-VI-2026) counts 130 Contracting Parties; we did not find Cuba among those listed.[2] The HCCH page of authorities lists Cuba's authorities under the Child Abduction, Adoption and Child Protection Conventions; we found no apostille entry for Cuba there.[3]
We found no Cuban apostille authority, so the route described by the Spanish pages is legalisation. Spain's Foreign Ministry says foreign public documents that need diplomatic legalisation must be legalised first by the Foreign Ministry of the country that issues them and then by the Spanish diplomatic representation of the consular district.[4] Spain's Ministry of Justice warning says that "en el resto de los casos" there is an obligation to legalise public documents through the diplomatic route,[5] and describes the two steps, adding that the Spanish consular step carries a fee.[6] It also names the Foreign Ministry's Servicio de Legalizaciones in Spain, where it says legalisation is always free.[7] The warning calls legalisation of foreign documents an essential requirement.[8]
The Havana consulate's page says a Cuban document that needs validity in Spain must be legalised by the competent local authority, the Ministerio de Relaciones Exteriores, and lastly by the Spanish Consulate General in Havana.[9] It says it admits only originals (or authentic copies issued by the body that issued the original), and that legalised photocopies cannot replace the original.[10]
Who legalises in Cuba has changed. A notice of the Cuban Foreign Ministry, dated 3 February 2025, says the function of legalising documents to take effect abroad and in the national territory passed from the Foreign Ministry to the Ministry of Justice.[11] The Ministry of Justice says the same for documents for use abroad (its page is dated 16 April 2025), and that its scope includes birth, marriage and death certificates, handled at the Bufetes Colectivos, the Bufetes Especializados or the Consultoría Jurídica Internacional.[12][13] It says you present the originals with the copies needed and pay a variable tariff depending on the type of document and the destination country.[14] Its FAQ adds that the Consultoría Jurídica Internacional offers obtaining and legalising educational and registry documents for use abroad.[15] The Spanish consulate's page, which we found undated, still names the Foreign Ministry as the local authority.[16] We found no Spanish page that mentions the Ministry of Justice, and no printed price or delay for legalising a birth certificate: ask the registry or the consulate.
Documents from a Cuban consulate in Spain are a different case. Spain's Foreign Ministry says documents issued by foreign representations in Spain that refer to facts or data within their consular district must be legalised by its Legalisation Service to be valid in Spain,[17] and lists certificados de buena conducta among its examples of consular documents.[18] Barcelona's consular tariff table lists a legalisation of the signatures of officials on documents issued in Cuba for use abroad at 80 €,[19] and lines for legalising documents at the embassies in Havana (70 €) and at the Ministry of Justice (50 €).[20] We found no page saying whether Spain accepts a document legalised that way for a nationality file: ask the registry. Spain's Foreign Ministry also says that, for Registro Civil procedures only, the legalisation by the Spanish diplomatic representation in some countries can be replaced by that of the foreign country's diplomatic representation in Spain, followed by legalisation at its Servicio de Legalizaciones.[21][22] We found no page naming the countries or saying whether this applies to Cuba or to a nationality file.
Spain's Foreign Ministry says legalisation has no expiry date but, if the document has a validity period, legalisation does not extend it.[23]

4. Translation into Spanish
We found no official Cuban or Spanish page saying that a document already in Spanish needs, or does not need, a translation. Spain's order says "traducido en su caso" for the birth certificate and "traducido" for the criminal record.[1][2]
The Spanish Ministry of Justice warning says translation is done or checked at Spanish consulates abroad or at the consular offices in Spain of the document's country of origin, and that the documents must then be legalised. It adds that a sworn translator-interpreter named by the Ministry of Foreign Affairs can do the translation or check.[3][4]

6. Order of requests and validity
Spain's order says that all documents must be in force when you apply.[1] For certificates, the validity stated on the certificate itself counts,[2] and a criminal record certificate with no stated validity counts for six months from the day it was issued.[3]
Legalisation does not make a document last longer. Spain's Foreign Ministry says legalisation has no expiry date but that, if the document has a validity period, legalisation does not extend it.[4]
When you create the online application you have two months to complete and file it, or it is deleted.[5]
Our arithmetic, not an official rule. The sources above fix how long a document stays valid, not the order in which you request things. If the validity counts from the day of issue, and the legalisation and a sworn translation take time afterwards, the request date matters most for the documents with the shortest validity. Type a date in the clock below to see when your criminal record certificate stops being valid, then count back the time the legalisation and the translation take in your case.
- Find out what validity, if any, each issuer prints on its certificate (the sections above say what we found).
- Request first the documents that need a legalisation and a sworn translation, since those steps come after issue.
- Request the criminal record certificate when you can still finish its legalisation and translation inside its validity.
- Type its issue date in the clock below and file before the "valid until" date it shows.
- Create the online application only when you are close to filing: from creation you have two months.
