Criminal record certificate from Venezuela for a Spanish nationality file: who issues it and how long it stays valid

What the official pages of Venezuela and of Spain say about the criminal record certificate: who issues it, how to ask for it from Spain, cost and time where they are stated, and how long it counts for your file, with a source under every line. Reading this page is free.

Validity clock: your dates, worked out

Type a date you already have and read the date it leads to, with the official rule beside it. Nothing is stored or sent: the calculation runs in your browser. Add a date to your calendar with a reminder.

How we count

Months and years end on the same day number, or on the last day of the month if there is no such day; they start the day after the date you give. A deadline that ends on a weekend moves to the next working day. Document validity is not moved: the date shown is the last day it stays valid, even on a weekend. Days are working days unless a law says otherwise.

In short

  • Criminal record: The Ministry of Interior, Justice and Peace handles the certificate; we found no Venezuelan validity period, and Spain's order counts a record with none stated as valid for six months from issue.

Each line sums up a section below. The sources are in that section.

1. Criminal record certificate

The Venezuelan consulate in Barcelona says in its FAQ that the criminal record certificate is handled directly through the Ministry of Interior, Justice and Peace's page "Solicitud de Certificación de Antecedentes Penales para Trámites Internacionales".[1]

The same FAQ says that for help with criminal records you must contact the Ministry by email at antecedentespenales@mijp.gob.ve.[2]

The Law on the Register of Criminal Records says the ministry in charge of interior, justice and peace keeps and directs the register.[3] It says a fee (tasa) must be paid for a certificate requested from that ministry,[4] and that the ministry sets the amount by resolution, within limits set in the law.[5] We found no official page that states the current amount.

For Venezuelans living abroad, the Venezuelan embassy in Austria describes registration in the criminal records system (SIGESAP) as a consular procedure that lets nationals abroad register to request their Carta de Antecedentes Penales.[6]

The Barcelona consulate has a page titled "Registro de ciudadanos en el SIGESAP".[7] The page carries a notice that the procedure is suspended.[8] We cannot tell from the page whether the notice is still current. The same page gives a consular fee of 60 euros in cash[9] and a time of 10 working days after the requirements are received.[10] Those figures refer to that registration procedure, not to the certificate itself.

Validity. We found no Venezuelan page that states a validity period for the criminal record certificate. Spain's order says all documents must be in force when you apply, and that a criminal record with no stated validity counts for six months from the day it was issued.[11][12]

Spain's order lists Venezuela among the federal states and says the certificate must cover the whole country, not only one federated state.[13] We found no Venezuelan page that says whether the certificate covers the whole country: ask the Ministry.

Spain asks for the criminal record certificate of the country of origin, legalised and translated.[14]

When to see a lawyer

  • A document is refused and you do not know why.
  • Your names are spelled differently in your documents.
  • A required document cannot be obtained.
  • You are near a deadline.

These are general triggers, not an assessment of your case. A lawyer should confirm what applies to you. CiviqPass does not name or recommend a lawyer.
