How we count

Months and years end on the same day number, or on the last day of the month if there is no such day; they start the day after the date you give. A deadline that ends on a weekend moves to the next working day. Document validity is not moved: the date shown is the last day it stays valid, even on a weekend. Days are working days unless a law says otherwise.

In short

  • Criminal record: You can request the certificate from the Peruvian Judiciary online or at a consulate; the Judiciary says 90 calendar days and the Foreign Ministry at most three months, and the clock below shows the earlier of the two.
  • Birth and marriage: RENIEC issues certified copies of birth records, online as well; the Foreign Ministry suggests a validity of no more than three months, and we found no official validity period.
  • Apostille: The Foreign Ministry is Peru's apostille authority; its FAQ says the apostille has no expiry date, but the validity of the apostilled document depends on the country where it will be used.
  • Translation: We found no official page saying whether a document already in Spanish needs translation; Spain's order says "traducido en su caso" for the birth certificate and "traducido" for the criminal record.
  • Order: Our arithmetic, not an official rule: request first the documents that need an apostille and a sworn translation, then the criminal record certificate, so that you can finish its apostille and translation while it is still valid; the clock below gives the dates.

Each line sums up a section below. The sources are in that section.

1. Criminal record certificate

The Peruvian Judiciary's page says the Certificado de Antecedentes Penales is an official document that certifies whether a person has convictions imposed for committing an offence.[1]

  1. gob.pe, Antecedentes Penales: descripciónOfficial wordingEs un documento oficial que certifica si una persona registra o no sentencias condenatorias impuestas como consecuencia de haber cometido un delito.

2. Birth certificate, and marriage certificate if you are married

The Peruvian civil registry (RENIEC) says an adult who needs a certified copy of a birth, marriage or death record can request it from RENIEC.[1] If the record is not digitised in RENIEC's system, the page says to request it at the municipality where it was registered.[2]

RENIEC says people in the regions of Peru or abroad can get a certified copy of the birth, marriage or death certificate online, through its official website.[3] The page gives S/10.30 as the payment for the online procedure.[4]

One print only. RENIEC's page says the online document can be generated only once and is meant for immediate printing.[5] The same RENIEC note says the digital copy carries a QR code that certifies its validity.[6]

For the apostille, the Foreign Ministry's list of previous signatures covers certified copies of birth, marriage and death records issued by RENIEC and, separately, those issued by municipal civil registries. For both it says "Se sugiere" a validity of no more than three months.[7][8] For municipal records it lists certification by the municipal civil registrar and legalisation by the RENIEC signature authenticator.[9] We found no page saying whether a copy printed from the RENIEC website can go straight to the apostille: ask the Foreign Ministry.

Spain asks for the birth certificate of the country of origin, legalised and translated where needed.[10] If you are married, it also asks for the marriage certificate of the country where the marriage took place.[11] We found no official Spanish text saying which kind of copy (extract or full) it wants: ask the registry.

Validity. Spain's order says all documents must be in force when you apply.[12] We found no official page that states a validity for a Peruvian birth certificate; the only figure we found is the Foreign Ministry's suggestion of three months.[13]

3. Apostille and legalisation

The HCCH status table lists Peru with an accession dated 13 January 2010 and entry into force on 30 September 2010.[1] The HCCH page lists the Ministerio de Relaciones Exteriores as Peru's designated competent authority.[2]

The Foreign Ministry says the apostille certifies the authenticity of the signature and the position of the Peruvian official who signed a document issued in Peru.[3] It says it apostilles only documents issued by Peruvian public authorities.[4]

Its list of previous signatures says the apostille of a criminal record certificate takes a digital certificate issued by the Registro Nacional de Condenas.[5] Its FAQ lists, for now, only these documents for digital apostille: criminal record certificates, judicial record certificates, SUNEDU certificates, digital translations, ONP and Migraciones certificates.[6] The same answer adds that all documents carrying an electronic validation element, such as a QR code or verification link, can be certified digitally.[7] We found no page that names RENIEC copies in that list: ask the Foreign Ministry.

The prices in the FAQ are 31 soles in person and 18 soles digital.[8] The digital page says the document is certified within a maximum of 5 working days.[9] In person, the page says to return up to 5 working days later, or when the official tells you, to collect it.[10] If the document has a handwritten signature, the page says you must go in person to the Ministry's head office.[11]

The digital page says it is mandatory to check beforehand with the receiving State's entity whether it accepts a digital apostille or legalisation.[12] We found no Spanish page saying whether a digital apostille is accepted for a nationality file: ask the registry. For questions, the Ministry gives legalizacionyapostillatrc@rree.gob.pe.[13]

The FAQ asks whether Peruvian consular offices abroad can apostille Peruvian public documents and answers no: it says this is done only at the head office, the decentralised offices of the Ministry and the five MAC centres.[14]

The Peruvian FAQ says the apostille has no expiry date, but the validity of the apostilled document depends on the internal procedure of the country where it will be used.[15] Spain's Foreign Ministry says legalisation has no expiry date but, if the document has a validity period, legalisation does not extend it.[16]

Spain's Foreign Ministry says documents from countries that signed the Apostille Convention are not legalised.[17]

A certificate issued by a consulate is a different case. The Barcelona consulate's page says that for the document to be valid in Spain you must legalise it at the Spanish Ministry of Foreign Affairs.[18] Spain's Foreign Ministry says documents issued by foreign representations in Spain that refer to facts or data within their consular district must be legalised by its Legalisation Service to be valid in Spain.[19] The Ministry of Justice warning calls legalisation of foreign documents an essential requirement, and says legalisation at that Service is always free.[20][21]

4. Translation into Spanish

We found no official Peruvian or Spanish page saying that a document already in Spanish needs, or does not need, a translation. Spain's order says "traducido en su caso" for the birth certificate and "traducido" for the criminal record.[1][2]

The Spanish Ministry of Justice warning says translation is done or checked at Spanish consulates abroad or at the consular offices in Spain of the document's country of origin, and that the documents must then be legalised. It adds that a sworn translator-interpreter named by the Ministry of Foreign Affairs can do the translation or check.[3][4]

5. Consulates in Spain

The Peruvian Foreign Ministry's list of consular offices names ten consular offices in Spain: consulates general in Barcelona, Madrid, Valencia, Sevilla and Bilbao[1] and consulates in Palma de Mallorca, Salamanca, Santa Cruz de Tenerife, Vigo and Las Palmas de Gran Canaria.[2]

We did not read the area each consulate covers; the only one we saw is in the Madrid page quoted above. Check the page of the consulate for your province before you apply.

6. Order of requests and validity

Spain's order says that all documents must be in force when you apply.[1] For certificates, the validity stated on the certificate itself counts,[2] and a criminal record certificate with no stated validity counts for six months from the day it was issued.[3]

Legalisation does not make a document last longer. Spain's Foreign Ministry says legalisation has no expiry date but that, if the document has a validity period, legalisation does not extend it.[4]

When you create the online application you have two months to complete and file it, or it is deleted.[5]

Our arithmetic, not an official rule. The sources above fix how long a document stays valid, not the order in which you request things. If the validity counts from the day of issue, and the apostille and a sworn translation take time afterwards, the request date matters most for the documents with the shortest validity. Type a date in the clock below to see when your criminal record certificate stops being valid, then count back the time the apostille and the translation take in your case.

  1. Find out what validity, if any, each issuer prints on its certificate (the sections above say what we found).
  2. Request first the documents that need an apostille and a sworn translation, since those steps come after issue.
  3. Request the criminal record certificate when you can still finish its apostille and translation inside its validity.
  4. Type its issue date in the clock below and file before the "valid until" date it shows.
  5. Create the online application only when you are close to filing: from creation you have two months.
